This Privacy Policy applies to the processing of users’ personal data carried out by FERCOPOR within the scope of the use of the website https://www.fercopor.pt and all its subdomains (hereinafter referred to as the “Website”), as well as any contact forms, information requests, or other digital interactions made available to the user.
FERCOPOR undertakes to process users’ personal data in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”), Law No. 58/2019 of 8 August, and other applicable legislation regarding the protection of personal data.
FERCOPOR may collect the following categories of personal data:
Identification data: full name, tax identification number, date of birth;
Contact data: email address, telephone number, postal address;
Browsing data: IP address, browser type, pages visited, time spent on the site, cookies, and session identifiers;
Communication data: content of messages sent via contact forms or email;
Professional data: company, job title, industry sector, when voluntarily provided by the user.
The personal data collected is processed for the following purposes:
Responding to requests for information, contact, or clarification submitted by the user;
Management and follow-up of purchase processes, reservations, or expressions of interest in properties;
Sending commercial and promotional communications, subject to the prior and express consent of the data subject;
Compliance with legal and regulatory obligations applicable to real estate activities;

The processing of personal data by FERCOPOR is based on the following legal grounds, pursuant to Article 6 of the GDPR:
Performance of a contract or pre-contractual measures: when processing is necessary to respond to requests from the data subject related to property acquisition;
Compliance with a legal obligation: when processing is required by applicable legislation;
Legitimate interest of FERCOPOR: specifically for system security, fraud prevention, and anonymous statistical analysis;
Consent of the data subject: for the sending of commercial communications and the use of non-essential cookies.
Personal data is stored for the period strictly necessary to fulfil the purposes justifying its processing, observing the following criteria:
Data collected for information requests without contractual finalisation: stored for a maximum period of 3 (three) years;
Data associated with contractual relationships: stored for the duration of the contract and for the applicable legal limitation period, not less than 10 (ten) years;
Data processed based on consent: stored until consent is withdrawn by the data subject;
Browsing data and cookies: stored in accordance with the periods indicated in the Cookie Policy.
As a rule, users’ personal data is processed within the European Economic Area (EEA). In the event of any transfer to third countries, FERCOPOR will ensure that it is carried out with adequate safeguards under Chapter V of the GDPR, namely through the adoption of Standard Contractual Clauses approved by the European Commission.
Personal data may be communicated to the following categories of recipients:
Subprocessors providing services to FERCOPOR regarding Website management, CRM platforms, email marketing tools, and analytics, bound by subprocessing agreements compliant with the GDPR;
Judicial, administrative, or regulatory authorities, in cases where disclosure is legally required;
Companies within the FERCOPOR Group;
Commercial partners, subject to the prior and express consent of the data subject.
FERCOPOR does not sell, assign, or transfer personal data to third parties for marketing purposes without the consent of the respective data subject.
Under the GDPR, data subjects have the following rights, which they may exercise at any time:
Right of access: to obtain confirmation as to whether or not personal data is being processed and, if so, to access it and the information provided for in Article 15 of the GDPR;
Right to rectification: to request the correction of inaccurate or incomplete personal data pursuant to Article 16 of the GDPR;
Right to erasure (right to be forgotten): to request the deletion of their personal data in the situations provided for in Article 17 of the GDPR;
Right to restriction of processing: to request the restriction of the processing of personal data in the situations provided for in Article 18 of the GDPR;
Right to object: to object at any time to the processing pursuant to Article 21 of the GDPR;
Right to data portability: to receive the data provided in a structured, machine-readable format pursuant to Article 20 of the GDPR;
Right to withdraw consent: at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

FERCOPOR undertakes to respond to requests within 30 (thirty) days of receipt; this period may be extended by a further 60 (sixty) days in cases of particular complexity, with notice provided to the data subject.
Data subjects have the right to lodge a complaint with the National Data Protection Commission (CNPD), located at Rua de São Bento, n.º 148, 3.º, 1200-821 Lisbon, or via the email address geral@cnpd.pt, if they consider that the processing of their personal data violates the GDPR or applicable national legislation.
FERCOPOR implements appropriate technical and organisational measures to ensure a level of security appropriate to the risk, including the use of encryption protocols, access control, and incident response procedures, in accordance with Article 32 of the GDPR.
FERCOPOR reserves the right to update this Privacy Policy at any time in response to legislative, regulatory, or operational changes. The updated version will be published on the Website, indicating the date of the last revision. Users are encouraged to consult this document periodically.
